BUYER'S RIGHT OF WITHDRAWAL
RIGHT OF WITHDRAWAL
1.1 The Buyer has the right to withdraw from the Contract within 14 (fourteen) days without giving any reason and without paying any penalty.
1.2 The period of right of withdrawal starts on the day the Contract is established for Contracts related to the performance of services; and on the day the Buyer or a third party determined by the Buyer receives the goods for Contracts related to the delivery of goods. The Buyer may also exercise the right of withdrawal during the period from the establishment of the Contract until the delivery of the goods.
1.3 In determining the period of the right of withdrawal,
a) For goods that are subject to a single order and delivered separately, the day the Buyer or a third party designated by the Buyer receives the last goods,
b) For goods consisting of more than one piece, the day the Buyer or a third party designated by the Buyer receives the last piece,
c) In contracts where the goods are delivered regularly for a certain period of time, the day on which the Buyer or a third party determined by the Buyer receives the first goods is taken into account.
1.4 The delivery of the Product by the Seller to the carrier is not considered as delivery to the Buyer. In contracts where the delivery of goods and the performance of services are made together, the provisions of the right of withdrawal regarding the delivery of goods apply.
1.5 The Buyer may send a notice of withdrawal to the Seller's e-mail address specified in Article 1 (info@focsel.com) within 14 (fourteen) days.
1.6 In order for the return process to be carried out, the invoice sent to the Buyer must be given to the Seller.
1.7 The Buyer shall not be liable for any changes or deteriorations that occur if the product is used in accordance with its operation, technical specifications and usage instructions within the withdrawal period.
1.8 The product or products to be returned must be returned as a whole, including its box, packaging and standard accessories, if any.
1.9 The Seller shall refund the total price (the total of all prices paid by the Buyer to the Seller, including delivery costs, if any) to the Buyer within 14 (fourteen) days at the latest from the date of receipt of the notice of withdrawal. The Seller shall make all refunds in a single payment in accordance with the payment method used by the Buyer during the purchase and without imposing any expense or liability on the Buyer.
1.10 The shipping costs of products returned due to the use of the right of withdrawal will be covered by the Seller. After the Buyer uses the right of withdrawal and notifies the Seller in this regard, he/she must send the returned product to the Seller via Yurtiçi Kargo, the Seller's contracted cargo company, within 10 (ten) days at the latest. For sales made abroad, the returned product will be sent to the Seller by the Buyer via UPS. In such cases, the Buyer will not pay the shipping costs. The information about the cargo companies contracted by the Seller for the use of the right of withdrawal and product return is as follows:

1.11 If the Seller's contracted cargo company, Yurtiçi Kargo, does not have a branch in the Buyer's place of residence, the Seller will ensure that the product is collected from the Buyer and the Buyer will not pay the cargo fee.
1.12 The decrease in the value of the goods received or the existence of a reason that makes return impossible does not prevent the use of the right of withdrawal. However, if the decrease in value or the impossibility of return is due to the fault of the Buyer, the Seller must compensate the Seller for the value of the goods or the decrease in its value. Changes and deteriorations due to the ordinary use of the goods are not considered as decrease in value.
1.13 Subject to the provisions of Article 30 (thirtieth) of the Law, if the Buyer exercises his right of withdrawal, the side contracts will automatically terminate. In this case, provided that the Buyer does not use the product in accordance with its operation, technical specifications and usage instructions within the withdrawal period, the Buyer is not liable to pay any expenses, compensation or penalties, provided that the changes and deteriorations that occur are reserved.
1.14 The Seller shall immediately notify the third party party to the subsidiary contract that the Buyer has exercised his right of withdrawal.
CASES WHERE THE RIGHT OF WITHDRAWAL CANNOT BE USED
2.1 The Buyer cannot exercise the right of withdrawal in the following cases:
a) Special production products prepared in accordance with the Buyer's requests cannot be returned or exchanged except in defective cases. The right of withdrawal cannot be exercised for these products.
b) Contracts regarding goods prepared in line with the Buyer's wishes or personal needs.
c) Contracts for the delivery of goods that are perishable or subject to expiration.
d) Contracts regarding the delivery of goods whose protective elements such as packaging, tape, seal, or package have been opened after delivery; and whose return is not suitable for health and hygiene reasons.
e) Contracts concerning goods that are mixed with other products after delivery and cannot be separated due to their nature.
f) Contracts regarding books, digital content and computer consumables presented in material form, if protective elements such as packaging, tape, seal, package have been opened after delivery of the goods.
g) Contracts regarding the delivery of periodicals such as newspapers and magazines, other than those provided within the scope of a subscription contract.
h) Contracts for services performed instantly in electronic environment or intangible goods delivered instantly to the Buyer.
i) Contracts regarding services that are started to be performed with the Buyer's approval before the expiry of the right of withdrawal period.
